Acceptance of Terms By subscribing to and using the WhatsApp Business API services offered through Media Minds Creations ("we", "us", "our"), you ("User", "Client") agree to abide by these Terms and Conditions, Meta’s WhatsApp Business Policy, and all applicable laws and regulations. 2. User Responsibilities The API services must only be used for lawful, business-related purposes. Users must strictly comply with Meta’s WhatsApp Business Policy, Commerce Policy, and any updates released by Meta. Engaging in spam, misrepresentation, or deceptive marketing practices is strictly prohibited. Users are responsible for ensuring their use of the platform does not violate local, national, or international laws. 3. Account Security Users are solely responsible for securing their WhatsApp Business API account credentials and related access information. Users must immediately report any unauthorized use, data breach, or suspicious activity to Media Minds Creations. We are not liable for damages caused due to compromised credentials or negligence in maintaining account security. 4. Payments and Billing Users agree to pay all applicable subscription fees, message costs, template charges, and taxes as per the selected plan and usage. All payments must be made promptly and through approved payment channels. Failure to make payments may lead to temporary suspension, limited access, or permanent termination of the service. Invoices and payment history will be made available via the billing dashboard or through email on request. 5. Data Privacy and User Consent Users must obtain explicit and verifiable consent from their customers before sending any communication over WhatsApp. All messaging and data-handling practices must adhere to applicable data protection laws, such as: India’s IT Act, 2000 DPDP Act, if applicable GDPR (for international clients/customers) Users must ensure transparency in how customer data is collected, stored, and used, and provide an accessible privacy policy link within their business profile. 6. Content & Template Messaging All message templates must be pre-approved by Meta before use. Promotional or unsolicited messages without proper consent may result in restrictions or banning of the WhatsApp Business number. Templates must be accurate, non-deceptive, and clearly represent the intended use case. 7. Compliance with Meta Policies Users must strictly comply with all applicable Meta documentation, including: WhatsApp Business Policy Developer Terms Platform Terms and Guidelines Meta reserves the right to review, restrict, or terminate access to the API if violations are detected. 8. Service Suspension or Termination We reserve the right to suspend or terminate a user’s access to the WhatsApp Business API if: The user breaches these Terms or Meta’s terms; The user fails to pay applicable dues; Regulatory or legal violations are reported; A request is made by Meta or any governing authority. 9. Limitation of Liability Media Minds Creations is not liable for any direct or indirect loss, service interruptions, or penalties arising from use or inability to use the API, including policy violations enforced by Meta.
